<p>The Orange County Vacation Rental Association, in addition to many independently owned & operated short-term rentals throughout San Clemente, <strong>support common sense regulations which incorporate good neighbor policies - to preserve the peaceful quality of our neighborhoods for all residents & visitors alike. </strong></p><p><strong> </strong></p><p><strong>We Support: </strong></p><ul><li>Stronger enforcement of Noise Abatement Laws</li><li>Standardized Regulations (Occupancy Limits, Parking Limits)</li><li>An improved registration system that increases accountability & TOT collection</li><li>Mandatory TOT# posting on marketing materials & posting of 24/7 contact information to improve transparency & address concerns should they arise</li><li>The City of San Clemente clarifying the municipal code to clearly define short-term rental tenants the same as long-term rental tenants</li></ul><p><strong><em>Rationale: </em></strong><em>Everyone deserves the right to a peaceful neighborhood. All homeowners, owner/managers of long-term and short-term rentals should be held to the same standard. Partying college students, bar staff and barking dogs are some of the biggest nuisances (and for permanent or long-term residents, it's on a much more consistent basis). All neighbors deserve the same protections!</em> </p><p> </p><p>We do not support regulations that fail to accomplish the above goals & restrict homeowner's rights - while providing no discernible or measurable benefit to the community, small businesses, or tourists visiting The Spanish Village By The Sea. </p><p> </p><p><strong>We DO NOT Support: </strong></p><ul><li>Regulating length of stay (i.e. minimum number of days)</li><li>Limiting the # of days a home can be rented in a given period (month/year)</li><li>Limits on quantity of properties</li><li>“Banning” short term vacation rentals in any specific neighborhood or land-use zone</li></ul><p><strong><em>Rationale: </em></strong><em>Those opposed to Short-Term Rentals have many valid concerns. When deconstructed, these concerns consistently boil down to frustrations regarding noise & nuisances. When we focus on eliminating these issues there is no reason to limit homeowner's rights, deter tourism, and negatively impact both municipal and local business revenue. These types of restrictions have been attempted in other cities and proven ineffective, difficult to track and/or enforce. A lack of compliance will result in operators going underground, resulting in significantly less TOT earnings for the City of San Clemente.</em></p>
